Sexual Offences

R v AK [2013] Snaresbrook Crown Court - The defendant was charged with offences stemming under the umbrella of ‘Operation Yewtree’. Following transfer of his legal representation at the police station he was represented by instructing solicitor and Counsel Ms Sarah Forshaw QC. Throughout the trial preparation and process it became apparent that the investigating departments were withholding information that would clearly gave rise to doubt in respect of the account provided by the victim. Following in depth research by those instructed in regards to instructions by the defendant as well as numerous mentions for non- disclosure and delay on behalf of the Crown an application was made to dismiss. Further provided material by the defence in respect of the victim also finally yielded a notice of discontinuance and the Crown formally offered no evidence against the defendant after a year of proceedings.
